Highway Law Services Ltd offers its clients 33+ years worth of experience and expertise in assisting with the legal aspects relating to the maintenance and management of the whole highway network in England and Wales, being motorways, roads, cycle tracks, byways, restricted byways, bridleways and footpaths.

Jenny Trevor, who heads up the business, worked for Essex County Council for 16 years and then Atkins for 15 years.

Whilst with Essex County Council she gained her experience, was invited to lecture modules entitled ‘An Introduction to Highway Law’ at Anglia Polytechnic University and became the council’s expert witness in court cases and public inquiries relating, mainly, to boundary and status disputes on all highways for which the county were responsible ie motorways, roads, cycle tracks, byways, bridleways and footpaths.

During her time with Atkins her expertise were utilised to provide assistance to both private and public sector clients, the following being a few examples:

 

For Local Authority Clients she:

  • advised on their statutory duties and related services;

  • assisted generally with inquiries made from the public;

  • project managed a scheme to convert 18 footpaths to cycle tracks. After a lengthy consultation process and a public inquiry, the Secretary of State confirmed the Orders without modification;

  • assisted with the preparation and consultation for the publication of a number of Rights of Way Improvement Plans;

  • reviewed public rights of way (ie footpath, bridleway and byway) applications made under Section 53 of the Wildlife and Countryside Act 1981, progressing cases from application to final recommendation, carrying out all necessary research and consultation. In one case where Jenny and her team were commissioned to process fourteen claimed footpaths in a single parish, all decisions were objected to but all were upheld without modification by the Inspector in the resulting Public Inquiry;

  • drafted appropriate Modification Orders;

  • assisted with the making of a number of Statutory Orders (Traffic Regulation Orders, extinguishment/stopping up Orders, public path Orders) ensuring the legal requirments of the regulations were adhered to.

  • acted as expert witness in a number of public inquiries and court cases mainly relating to boundary, status and obstruction matters but also including traffic offence cases.

 

For private clients she:

  • has used her experience from the public sector to assist private individuals in their dealings with their local authorities. Usually difficult matters not necessarily understood by the layman;

  • has used her expertise to assist solicitors, developers and planners with simple and complex highway law problems;

  • has assisted a large utility company in a successful claim against a contractor where the re-instatements were found to be defective and non-compliant under the New Roads and Street Works 1991 (NRSWA);

  • has been commissioned by a number of solicitors to report on whether the highway authority's defence under s58 Highways Act 1980, in the case of personal injury accidents on both roads and footpaths, stands up;

  • has assisted members of the public with applications relating to obstructions of the highway under s130A-D Highways Act 1980;

  • has assisted with objections to Modification Order applications and Orders made under s53 Wildlife and Countryside Act 1981 (WCA81) and been successful.

Highway Law Services is registered with the Information Commission Office (ico) under the Data Protection Act 1998 - the current entry on the register running from 27 March 2014 to 26 March 2015.

On 1 April 2013, Jenny was appointed as a Director of the Institute of Public Rights of Way and Access Management (IPROW)

On 20 May 2013 Jenny was granted Licensed Access by the Bar Council to instruct Counsel direct.
